Fair Labor Standards Act (FLSA) DEcision

The FLSA decision was released by the Arbitrator Wasserman on 11/29/07.

From the decision award, the grievance focused on:

"1)which statute(s) determines how U.S. Park Police officers are entitled to be compensated when working overtime,
2) the nature of the overtime work and type of compensation that officers are to recieve,
3) as well as the application and authority of agency regulations and policies, and the collective barginning unit"

The decision was favorable for the members of the Labor Committee. The arbitrator determined that the USPP should be pay back wages to officers who worked overtime hours but were required to be compensated with comp time rather then the overtime pay of time and half. Officers can now decide if they want overtime (time and a half) or comp time ( 1 hour worked = 1 hour to be used later). Read the full decision.
